Article 1: general Conditions
The present general conditions of sale are for the knowledge of every buyer to allow him(her) to place order. As a consequence, the fact of placing order, implies the whole membership(support) and without reserve of the buyer on these general conditions of sale. Any opposite condition put by the buyer will thus be, for lack of express acceptance, inopposable to the salesman whatever is the moment when she will have been able to be carried(worn) in her knowledge.
Article 2: the Command(Order)
The information expressed by the buyer, during the grip of command(order) engages(opens) this one. In case of error in the wording of the coordinates of the addressee, the salesman would not know how to be considered responsible for the impossibility in which it is necessary to deliver the command(order). The commands(orders) are definitive only when they were confirmed by the regulation(payment) of the price by the buyer. Any modification or resolution of the command(order) by the buyer cannot be considered and the paid(poured) price will not be restored except when the salesman and the buyer agree. Photos presented in this Internet site are not contractual. The offers of product are valid within the limits of available stocks. In case of shortage of stock, the salesman saves himself the faculty(power) to deliver a product offering identical characteristics in dimension and quality.
Article 3: the delivery
The delivery is made from the moment the command(order) is settled(adjusted). Refer at the hours of command(order) for a delivery the next day, in the days of delivery and in the exceptions Chronopost and Fedex. If the day chosen by the delivery is not in accordance in the conditions of the deliverer, Castelanne will prevent(warn) the sender and its command(order) will be put in wait(expectation) until the decision of this one.

That the address of your addressee is exact and complete.

- If the addressee is absent during the delivery, an opinion of putting at disposition is left in its mailbox by the deliverer. The retreat of the product will then have to take place within 24 hours because of the perishable nature of the product. The delivery periods are indicated as exactly as possible.
The overtakings of delivery periods cannot give place to damages.
- If the address of delivery is erroneous, Castelanne would not know how to be considered responsible for the impossibility to make deliver the parcel.
However, if the product was not delivered or not given in the absence of the addressee in the daytime of delivery, for quite other cause that a case of force majeure, the sale can be then resolved and the buyer to obtain restoration of its price or the dismissal of another bouquet with the exception of quite other reparation or damages. The war, the revolt, the fire, the strikes, the accidents and the impossibility are considered as case of force majeure unloading(unburdening) the salesman of its obligation to deliver, to be furnished. The salesman will inform buyer of the cases or the events above enumerated.
The delivery for the periods(delays) can intervene only if the buyer is up to date of his obligations to the salesman.
Article 4: the guarantee (article of Law L. 121-20-2 of the Code of the Consumption)
The complaints concerning the delivered product (s) ( s ) have to be, as far as it is about fresh(cool) products with a date of short lapsing, formulated at the latest in 5 days by the delivery of the product. No damage and interest can be demanded by the sender or the addressee except guarantees Replaced or paid off.
Article 5: the return of the goods (except particular cases of the article 4)
In agreement with the rule foreseen by the article of law L. 120-20 of the Code of the Consumption, the buyer has a right of retraction of seven true days as from the reception of the possessions, and without having to prove motives or to pay of fines, for the exception, if need be, expenses of return. Article 6: the price
Products are supplied at the price current at the time of the signing of the command(order). If a technical problem intervened at the time of the command(order), and if the price was not respected the command(order) of the buyer will be put aside until the problem was settled(adjusted). The payment of the price is made counting during the grip of the command(order). The prices are guaranteed: - except exceptional events which can modify the class(course) of the cocoa or the transport or the cases of force majeure. - except increase of VAT.
Article 7: the disputes
The complaints or the contestings will always be received with attentive benevolence, the good faith being always presumed at the one who makes the effort to expose(explain) his situations. In case of dispute, the customer will address by priority the company to obtain an amicable solution. In defect, the courts of Nantes (the Atlantic Loire - France) will be only competent.
